DMCA & Fair Use Policy

Digital Millennium Copyright Act (DMCA) & Nominative Fair Use Compliance

PlayfinityOS is a non-custodial universal PC game launcher and local library manager. We respect the intellectual property rights of creators and publishers and strictly comply with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), the EU Digital Services Act (DSA), and international intellectual property frameworks. This page outlines our nominative fair use doctrine, trademark disclaimers, formal takedown procedures, counter-notification mechanics, and repeat infringer policy.

Section 1

1. Transformative Purpose & Non-Custodial Architecture

PlayfinityOS is a local software indexer and launcher, not a digital distributor, ROM host, or game mirror.

PlayfinityOS is an independent software application designed to catalog, organize, and launch digital video games already legitimately purchased, licensed, and installed on the end user’s personal computer across multiple platforms (such as Steam, Epic Games Store, EA App, Ubisoft Connect, GOG, Battle.net, and Xbox PC).

PlayfinityOS adds games by scanning the user’s own PC for games installed through these providers — without using, accessing, or transmitting any user data from them. No provider accounts, credentials, or personal information are ever accessed; only installed games found on the user’s own machine are added to the launcher.

PlayfinityOS does NOT host, upload, pirate, bypass DRM for, crack, mirror, or distribute playable video game software, executable game binaries, ROMs, or digital game codes. All game executions occur locally on the user’s own hardware via the respective official third-party platform launchers or local file systems.

Section 2

2. Nominative Fair Use & Trademark Disclaimer

All publisher/developer game titles, box art, logos, and trademarks are the property of their respective owners and used solely to identify user-owned games.

All video game titles, cover art, key art, screenshots, trailers, logos, trademarks, service marks, and trade dress displayed within the PlayfinityOS desktop application, marketing materials, and website are the exclusive property of their respective copyright and trademark owners (including, but not limited to, Valve Corporation, Epic Games Inc., Electronic Arts Inc., Ubisoft Entertainment SA, Microsoft Corporation, CD PROJEKT S.A., Sony Interactive Entertainment, Activision Blizzard Inc., and their subsidiaries).

The display of game titles, box art, and publisher logos in PlayfinityOS constitutes Nominative Fair Use under United States trademark law (15 U.S.C. § 1115(b)(4)), European Union Trademark Directive (EU) 2015/2436 (Article 14), and equivalent international intellectual property doctrines. Such visual identifiers are used exclusively for the transformative, descriptive, and utilitarian purpose of allowing users to identify, organize, and launch digital software they legally own and have installed.

PlayfinityOS is an independent utility and is NOT affiliated with, sponsored by, endorsed by, or in any way officially connected to Valve, Steam, Epic Games, Electronic Arts, Ubisoft, Microsoft, Xbox, GOG, Sony PlayStation, Nintendo, or any other game publisher or platform.

Section 3

Section 4

4. DMCA Notice & Takedown Procedure (17 U.S.C. § 512(c)(3))

Step-by-step statutory requirements for submitting a legally binding takedown notice.

If you are a copyright owner or an authorized agent thereof and believe that any content, promotional media, metadata, or artwork accessible on our website or hosted infrastructure infringes upon your copyright, you must submit a written notification containing all of the following statutory elements:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit us to locate the material (e.g., exact URL, asset hash, or API route).

4. Information reasonably sufficient to permit PlayfinityOS to contact you, such as your full legal name, physical address, telephone number, and email address.

5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including attorney’s fees and court costs.

Section 5

5. Expedited Takedown Response & Processing

How we promptly review, verify, and resolve compliant notices.

Upon receipt of a complete, compliant DMCA notice, PlayfinityOS acts expeditiously (typically within 24 to 48 business hours) to remove, disable access to, or modify the allegedly infringing material hosted on our servers, CDN, or online infrastructure.

If the challenged material was uploaded or supplied by an identified user or contributor, we will make reasonable efforts to promptly notify that individual of the removal and provide them with a copy of the notice and instructions regarding counter-notification.

Section 6

6. Counter-Notification Procedure (17 U.S.C. § 512(g))

The statutory mechanism for contesting erroneous or misidentified removals.

If you believe that your material was removed or disabled as a result of mistake, misidentification, or fair use justification, you may submit a formal Counter-Notification to [email protected] containing the following mandatory details:

1. Your physical or electronic signature.

2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed.

3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

4. Your legal name, physical address, and telephone number, along with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the US, the judicial courts of Spain / competent EU jurisdiction), and that you will accept service of process from the person who provided the original takedown notice.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If the original claimant does not notify us within 10 to 14 business days that they have initiated a court action seeking a restraining order against the content, PlayfinityOS may restore the disabled material.

Section 7

7. Repeat Infringer Policy (17 U.S.C. § 512(i))

Strict zero-tolerance rules for repeated copyright violations.

In accordance with Section 512(i) of the DMCA and EU digital regulations, PlayfinityOS maintains and enforces a strict repeat infringer policy.

We reserve the right, in our sole discretion, to terminate user accounts, revoke software licenses without refund, block API access, and permanently blacklist hardware identifiers (HWIDs) of users, developers, or contributors who repeatedly infringe intellectual property rights or generate bad-faith abusive submissions.

Section 8

8. User-Imported Local Artwork

Local customizations are client-side operations; enrichment media is delivered by PlayfinityOS's own database.

PlayfinityOS allows users to configure custom artwork, banners, box art, screenshots, and icons stored locally on their machines. Enrichment artwork and metadata are delivered exclusively through PlayfinityOS's own enrichment database.

PlayfinityOS does not pre-screen, store, or monitor user-imported local files. Users are solely responsible for ensuring that any local media or assets they import comply with applicable intellectual property laws.

Section 9

9. Modifications and Policy Updates

Ongoing commitment to intellectual property compliance.

PlayfinityOS reserves the right to amend or update this DMCA & Fair Use Policy at any time to reflect legal, regulatory, or technical developments. Updated versions will be published on this page with an updated timestamp.
